Dugout Terms of Service

These Terms of Service (“Terms”) govern access to and use of the Dugout platform at dugoutapp.com (the “Service”), provided by Pounce & Flow Ltd, a company registered in England and Wales under company number 17324576 with its registered office at 128 City Road, London, EC1V 2NX (“Dugout”, “we”, “us”).

By creating an account, accepting a Club invite, or using the Service, you agree to these Terms. If you're accepting on behalf of a Club, you confirm you have authority to do so.

1. Definitions

  • “Club”: an amateur football club with a Dugout account.
  • “Club Admin”: a user with administrative rights over a Club's Dugout account.
  • “Member”: any user with a Membership to a Club (Club Admin, coach, or Player).
  • “Player”: a Member with an associated Player record (squad, stats, availability).
  • “Membership”: the relationship between a User and a Club, which may be pending (awaiting approval) or active.
  • “Content”: data entered into the Service, including squads, match stats, fixtures, and availability responses.

2. Accounts and access

2.1 Sign-up and invites

Access to a Club's Dugout instance is granted either by:

  • Admin invite: a Club Admin issues an invite token to a new Member, or
  • Self-service join link: a Club Admin shares a join link, and the requesting user's Membership remains pending until an Admin approves it.

2.2 Two separate consents

When you join a Club on Dugout, you're asked to accept two distinct things:

  1. These Terms of Service and our Privacy Policy (your agreement with Dugout), and
  2. Membership of the specific Club (your agreement with the Club).

Accepting one does not imply acceptance of the other. You can be a Dugout user without being an active Member of any Club (for example, while a join request is pending).

2.3 Login

We use one-time login codes rather than passwords. You're responsible for keeping access to the email address associated with your account secure.

2.4 Account accuracy

You agree to provide accurate information and keep it up to date.

3. Subscriptions and billing

3.1 Plans

Dugout is offered to Clubs on a flat-cap subscription basis:

  • Club: up to 4 teams, £25/month or £250/year
  • Club Plus: up to 12 teams, £59/month or £590/year
  • Larger clubs can contact us for a custom plan.

Pricing is per Club, not per team or per user, and may change with reasonable prior notice.

3.2 Free trial

New Clubs get a 14-day free trial. No payment card is required to start a trial. If you don't subscribe by the end of the trial, your Club's access may be paused until you do.

3.3 Billing and cancellation

  • Monthly and annual billing cycles are available.
  • Payments are processed by Stripe. We do not store your card details.
  • “Cancel anytime” applies to monthly plans only. Annual plans are billed upfront for the year and are non-cancellable mid-term except as required by law; you can choose not to renew.
  • Fees are non-refundable except where required by law or at our discretion.

3.4 Non-payment

If a payment fails and isn't resolved within a reasonable period, we may suspend or downgrade the Club's access.

4. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose
  • Upload content that is defamatory, abusive, or infringes someone else's rights
  • Attempt to access another Club's data without authorisation
  • Reverse-engineer, scrape, or interfere with the Service's operation
  • Use the Service to process personal data of anyone under 18 (the current version is scoped to adult players/teams)

We may suspend or terminate accounts that breach these Terms.

5. Content and data ownership

5.1 Club data belongs to the Club

Clubs own the Content they and their Members enter into the Service (squads, stats, fixtures, availability, etc.). You grant Dugout a licence to host, process, and display this Content solely to provide the Service to that Club and its Members.

5.2 Data processing

Where Content includes personal data of Members or Players, the Club acts as data controller and Dugout as data processor. By accepting these Terms, the Club also agrees to Dugout's Data Processing Agreement, available at dugoutapp.com/dpa, which is incorporated into these Terms by reference and governs how we process that data on the Club's behalf.

5.3 Export

On request, we'll help a Club export its data in a reasonable format, including on termination of the subscription.

6. Availability and changes to the Service

We aim to keep Dugout available and reliable but don't guarantee uninterrupted access. We may modify, add, or remove features over time. We'll give reasonable notice of changes that materially reduce functionality Clubs rely on.

7. Disclaimers and liability

7.1 “As is” basis

The Service is provided “as is” without warranties of any kind, to the extent permitted by law.

7.2 Limitation of liability

To the extent permitted by law, Dugout's total liability arising from or related to the Service is limited to the amount paid by the Club in the 12 months preceding the claim. We are not liable for indirect or consequential losses, loss of data, or loss of profit.

Nothing in these Terms limits liability for death or personal injury caused by negligence, fraud, or anything else that cannot legally be limited or excluded.

8. Termination

  • A Club may cancel its subscription at any time (subject to Section 3.3).
  • We may suspend or terminate access if these Terms are breached, or if required by law.
  • On termination, Club access ends, though we will retain data for a limited period as set out in our Privacy Policy to allow for recovery or legal compliance.

9. Changes to these Terms

We may update these Terms from time to time. We'll notify Club Admins of material changes by email and update the “Last updated” date above. Continued use of the Service after changes take effect constitutes acceptance.

10. Governing law

These Terms are governed by the laws of England and Wales, and any disputes are subject to the exclusive jurisdiction of the courts of England and Wales.
